Monthly update on the judicial review of the procurement of global equity funds - May 2026
The Administrative Court in Stockholm is continuing to review Indecap’s application concerning the Swedish Fund Selection Agency’s procurement of actively managed global equity funds (case number 4909-26). Below is an account of how the process has developed during May.
On 17 April 2026, Indecap submitted a statement to the Administrative Court in which the company further developed its legal arguments and invoked additional new grounds in support of its claims, including extensive appendices.
The Swedish Fund Selection Agency was granted an extension until 29 May 2026 to respond to these new grounds and has worked on this during May. It is now up to the Administrative Court to decide on the next steps in the handling of the case. The procurement of actively managed global equity funds is so far the Swedish Fund Selection Agency’s largest procurement, with an estimated value of approximately SEK 200 billion. The Administrative Court is examining whether Fondtorgsnämnden has complied with the procurement rules applicable to the premium pension fund platform. No timetable has yet been set for when a judgment will be issued.
